Our policy is to maintain a current certification of insurance for our subcontractors for general liability, auto liability and worker's compensation. Insurance coverage must be provided by a carrier with an A.M. Best Rating no less than A VIII. All carriers providing coverage must be licensed to do business in California. Proof of all coverages listed below must be documented prior to Subcontractor beginning work.
REQUIREMENTS
- Comprehensive General Liability in the amount of $1,000,000 combined single limit for bodily injury and property damage and $2,000,000 general aggregate.
- Premises and Completed Operations coverage with Explosion, Collapse, Underground and Residential exclusions deleted, if applicable.
- Products and Completed Operations coverage for the full statute of repose at the time of contract execution.
- Standard Form Broad Form Comprehensive General Liability coverage.
- An endorsement naming Contractor and Owner Legacy Building Services, Inc. as additional insured [(Form B) CG2010 11-85 ISO edition or equivalent] must be provided. If the CG2010 11-85 is unavailable a comparable endorsement or combination of endorsements must be provided.
- An endorsement affording 30 days written notice to Contractor and Owner in the event of cancellation or material reduction in coverage.
- An endorsement providing that such insurance is afforded under Subcontractor's policy is primary insurance as respects to Contractor and Owner and any insurance maintained by Contractor and Owner is excess and non-contributing with insurance required hereunder.
- Comprehensive Auto Liability in the same amount of $1,000,000 combined single limit for bodily injury and/or property damage liability including:
- Owned auto
- Hired or borrowed autos
- Non-owned autos
- An endorsement affording 30 days written notice to Contractor and Owner in the event of cancellation or material reduction in coverage.
- Worker's Compensation and Employers' Liability Insurance as required by laws of the State of California and affording 30 days written notice of cancellation to Contractor in the amount of and including:
- Bodily injury by accident: $1,000,000 each accident
- Bodily injury by disease: $1,000,000 each employee
- Bodily injury by disease: $1,000,000 policy limit
- Waiver of Subrogation for Workers' Compensation and General Liability in favor of Legacy Building Services, Inc.
- Subcontractors performing any of the following: Grading, Excavation, Underground Utilities, Demolition, Paving, Hazardous Materials Removal and/or Disposal must provide Environmental Impairment Liability Insurance.
- Contractor and/or Owner reserves the right to require higher limits of insurance for high hazard trades or from Subcontractors with high value contracts.
- Risk Retention Groups or Captives are unacceptable alternatives to insurance.
- Deductibles or Retentions must be $10,000 or less, unless authorized by Contractors or Owners.
